  1. Requirements for swearing-in and appointment
    1. Any person – upon request – shall be generally sworn in and publicly appointed who
      1. is a citizen of a member state of the European Union or a contract state to the Agreement on the European Economic Zone, or is a holder of an unlimited residence permit,
      2. is of legal age;
      3. is dependable; a person shall generally be deemed non-dependable if he/she, during the last five years prior to the application, has been convicted of a crime or of theft, embezzlement, extortion, fraud, breach of trust, falsification of documents, false statements and perjury, dealing in stolen goods, profiteering, or of a crime involving insolvency;
      4. is professionally qualified, and
      5. has not been generally sworn in or publicly appointed as interpreter or translator in another German state, or has not been authorized pursuant to § 142 Sect. 3 Sentence 1 Civil Procedure Code.
    2. Professional qualification pursuant to Sect. 1 No. 4 shall be warranted for anyone who
      1. within the jurisdiction of the “Grundgesetz” (German Constitution)
        1. received a degree from a respective, accredited university as interpreter or translator,
        2. received a degree comparable with letter a) from a university
        3. received a certificate of completion from a state-certified examination as interpreter or translator

        or

      2. From outside the jurisdiction of the “Grundgesetz” (German Constitution)
        1. received an equivalent degree from a respective, accredited university as interpreter or translator,
        2. received a certificate of completion from an equivalent state-certified examination as interpreter or translator.
    3. The application shall be accompanied by the necessary documents and records to verify the professional qualification and dependability.
    4. With the exception of the swearing-in, all processes may be handled by the State Administrative Office (Landesverwaltungsamt) for the State of Saxony-Anhalt.
  2. Responsibility
    1. Responsibility for the general swearing-in and public appointment shall rest with the President of the Regional Court in whose district the applicant is domiciled. If the applicant is not domiciled in Saxony-Anhalt, the district of residence shall take precedence.
    2. The general swearing-in and public appointment of persons who neither are domiciled or maintain a residence in the State of Saxony-Anhalt shall be handled by the President of the Regional Court in Halle.

  3. Pursuant to §§ 68ff. VwGO, any rejection of the general swearing-in/authorization may be appealed within one month after the applicant has been informed of such rejection, in writing or to be recorded before the respective President of that Regional Court which issued the rejection of general swearing-in/authorization. Such deadline shall also be complied with be presenting such appeal to the President of the Higher Regional Court in Naumburg. If the respective President of the Regional Court does not provide any relief in this matter, the President of the Higher Regional Court in Naumburg shall decide on such an appeal.
